A tenancy agreement is the foundation of a safe, clear rental arrangement. Yet many tenants in Ghana move into a property based on a verbal understanding alone, with nothing written down. This leaves both tenant and landlord vulnerable if a disagreement comes up later. Why a Written Agreement Matters

A verbal agreement can be remembered differently by each side, especially months later when a disagreement arises. A written agreement, even a simple one, gives both parties something concrete to refer back to. It protects the tenant from unexpected rent increases or sudden eviction, and it protects the landlord by clearly setting out what's expected of the tenant.

You don't need an expensive, complicated legal document. A written agreement, even a page or two, signed by both parties, is far better than nothing.

What a Good Tenancy Agreement Should Include

The names of both parties. The landlord's full name and the tenant's full name, clearly stated.

The property being rented. A clear description of the property, including the address or location, and exactly which part of the property is included, the whole house, one room, or a chamber and hall, for example.

The rent amount and payment schedule. How much is being paid, how often, monthly or annually, and by what date each payment is due.

The length of the tenancy. Whether the agreement is for a fixed period, such as one year, or runs on a month to month basis, and what happens when that period ends.

Advance payments and deposits. Many landlords in Ghana request rent paid in advance, sometimes six months or a year at once. The agreement should clearly state how much advance is required, and whether any separate deposit is also being collected, and under what conditions that deposit is refundable.

What's included in the rent. Whether water, electricity, or any other utilities are included in the price, or paid separately by the tenant. This avoids confusion later about who's responsible for which bills.

Maintenance responsibilities. Who is responsible for repairs, ordinary wear and tear versus damage caused by the tenant, and how maintenance requests should be reported and handled.

Notice period. How much advance notice either party must give before ending the tenancy, whether that's the tenant wanting to move out, or the landlord wanting the tenant to leave.

Conditions for eviction. Under what circumstances a landlord can lawfully ask a tenant to leave, and what process should be followed. This protects tenants from sudden, unfair eviction without proper notice.

Ghana's Rent Act sets out certain legal protections and obligations for both landlords and tenants, including rules around notice periods and grounds for eviction. Requirements can vary depending on your specific situation and location, so if a dispute arises that you can't resolve directly with your landlord, it's worth seeking guidance from a qualified legal source or your local Rent Control office, rather than relying solely on general information found online.

Before You Sign

Read the full agreement carefully before signing, and don't feel pressured to sign on the spot if you need more time to review it. Ask questions about anything unclear, and if verbal promises were made that aren't reflected in the written agreement, ask for them to be added in writing. A landlord who genuinely intends to honor those promises should have no objection to including them.

Keep a signed copy of the agreement for your own records, and hold onto it for the full length of your tenancy.
