Rent cards, registration, increases, and advance limits.
Landlords in Ghana face new attention from the Rent Control Department in 2026. Rent cards, tenancy registration, and rules on rent increases and advance payments were all announced or restated in the space of a few months, with deadlines that fall before the end of the year. This guide is written for landlords and summarises what the department has said, so you can rent out your property properly and avoid problems with tenants or the department.
This guide is general information only and is not legal advice. It draws on news reports of statements by the Acting Rent Commissioner in 2026. Rules, deadlines, and enforcement can change, so confirm current details with your nearest Rent Control office.
Issue a rent card. Under Section 20(1) of the Rent Act, 1963 (Act 220), a landlord on a monthly or shorter tenancy must give the tenant a rent card within seven days of the tenancy starting. The card must show the names and addresses of the landlord and the tenant and the rent payable.
Register the tenancy. Residential landlords must register every lease or tenancy agreement with the Rent Control Department within 14 days, and give the department details of their tenants and the rent paid.
Key dates. From 17 August 2026, landlords seeking the department's services must show evidence that they have complied. The deadline for landlords to regularise their tenancy registrations and property records is 30 November 2026. Hostel operators whose accommodation falls under the rent laws must comply from the 2026/2027 academic year.
What happens if you do not. The department said failing to meet these duties is an offence, that it may delay, defer, or refuse its services until the landlord complies, and that it will not hear a landlord's complaint against a tenant unless the landlord has met these obligations. It said it would begin with education and a chance to comply, but would act against persistent or deliberate violations. In June, it also said that all landlords would be registered nationally and that unregistered landlords would not be served at any Rent Control office.
In a May 2026 interview, the Acting Rent Commissioner said that landlords cannot increase rent at will, and that doing so is illegal. A landlord who wants to adjust rent must apply to the Rent Control Department with evidence of maintenance or improvements. He said that landlords should keep proof of what they spent on maintenance and materials, and that a landlord who has not maintained a building for years cannot credibly blame higher costs. The practical lesson is to maintain your property, keep receipts for repairs, and apply formally before changing rent.
A landlord should not demand more than six months of rent in advance. Section 25 of Act 220 prohibits it, and a Ghanaian Times report in May 2026 said the offence carries a fine of 250 penalty units, reported as GH₵3,000, or three to six months in prison. In June, the department said landlords demanding more would be prosecuted, although strict enforcement would begin only after a period of public education. If you have been asking for a year or two in advance, now is the time to change your terms.
Put it in writing. Use a written tenancy agreement that states the rent, the advance, the length of the tenancy, who pays for water and electricity, and who handles repairs. The department is developing a proposed standard tenancy agreement, so check for it when it is published.
Give a receipt for every payment, and keep a copy. Receipts protect you if a payment is ever disputed.
Maintain the property, and keep photographs and receipts for repairs and improvements.
Avoid arbitrary actions. The department gave the example of locking the gate to stop tenants from returning home after 10 p.m. Settle disagreements through talking first, and then through the department.
Check your tenants. The department said landlords should verify the documents of foreign tenants, and meet their tax obligations.
Be honest in your listing. Describe the property, its water and electricity arrangement, and its price accurately. A tenant who finds that a listing was false is much more likely to dispute the tenancy.
The department said it plans a nationwide task force at district assemblies to educate communities and help resolve disputes, specialised rent courts with the Judicial Service and the Ghana Police Service to fast track rent cases, and a six month nationwide sensitisation programme on rent laws. Plans like these can change, so watch for official announcements.
